General Conditions of Sale
1. Introduction
The General Conditions of Sale detailed below (hereafter
called the “General Conditions”) govern the contractual relations between all users of the Transpiration.biz Website (hereafter called
“User” or “You”) and the Transpiration.biz brand belonging to Laboratoires i2m Sarl with a capital of 16,000 euros, head office at 16 bis
Fossés Saint Julien, 14000 Caen, France and entered in the Caen Trade Register under number 87 B 218 (hereafter called “i2m”).
Only
these General Conditions of Sale are applicable, and they replace all other conditions, unless a specific exception is made in writing. I2m
may change certain provisions of its General Conditions from time to time, and the Conditions must be re-read before each visit to the
Transpiration.biz site (hereafter called the “Website”). These changes may be queried from the moment when they are published on the
Website, and may not apply to contracts concluded previously. Each purchase from the Website is governed by the General Conditions
applicable on the date of the order. We consider that when you confirm your order, you have read and accepted our General Conditions of Sale
without reservations.
By accessing the Website, you undertake to observe the General Conditions and also the Conditions of Use stated
therein.
2. Placing an order
There are two ways in which you can place an order:

3. Product information
I2m takes the
utmost care over the information it puts on its Website concerning the basic features of the products, mainly in the form of technical
descriptions provided by its partners and suppliers and photographs illustrating the products, within the limits of the technique and in
accordance with the highest market standards.
4. Prices
The sale prices stated on the Website are in euros and include
tax, but not delivery charges. Any delivery charges are indicated to the User as and when the products are chosen, and are invoiced at the
end of the order together with the price of the selected products.
In the case of an order to a country other than Metropolitan
France, you are the importer or exporter of the products concerned. Customs duty or other local taxes, import duties or government taxes may
be due. These duties and sums are not the responsibility of Laboratoires i2m. They will be payable by you and you will be fully responsible
for making the appropriate declarations and payments to the competent authorities/bodies in your country. We advise you to obtain
information on these aspects from your local authorities.
i2m reserves the right to change its prices at any time, but the products will
be invoiced on the basis of the prices in force at the time of registration of the order, provided the products are available.
The
products remain the property of i2m until the price has been paid in full.
We reserve the right to change our prices at any time,
although we undertake to apply the prices that are stated on the Website at the time of your order.
5. Availability
We
will honour your order within the limits of our available stocks.
If one of the products you have ordered is not in stock, we undertake
to contact you by email within 15 days counted from the date of your order to inform you that the product is unavailable and of its expected
delivery date.
If some of the products you have ordered are temporarily unavailable, we undertake to send you the products that are
available, and to forward the rest of the order free of delivery charges.
The Website information on product availability is purely
indicative and under no circumstances represents a contractual commitment.
6. Delivery terms
Your order will be
delivered to the address stated on your order.
i2m makes every effort to honour the delivery times given on the Website. However, we
cannot be held liable for the consequences of late delivery or loss of a parcel caused by a third party or by you, or because of an
unforeseeable and unavoidable event constituting a case of force majeure.
If a parcel is not received by the stated delivery time, an
investigation will be conducted into the carrier and may take several days (e.g. 21 days for La Poste). No reimbursement or re-shipment may
be made during this period.
When you receive your order, we recommend that you check that the delivered products conform to the order,
and record any irregularities by making handwritten reservations accompanied by your signature on the delivery note.
Without prejudice
to the applicable legal guarantees, we recommend that you send any reservations regarding non-conformities of products ascertained on
delivery, as soon as possible by letter to I2m: Laboratoires i2m Service Client, BP 200 14011 Caen Cedex, or by email.
Returned products
can only be accepted in their original condition, i.e. with their packaging, accessories and instructions for use. Shipment costs will be
payable by the User.
In the case of a proven non-conformity, the User may choose between repair or replacement of the product, provided
one of these options does not entail a disproportionately higher cost than the other one.
We inform you that a delay of 24 h is possible
in the delivery of your order. For security reasons, all orders paid by card are verified by I2m.
Additional information may be requested
or demanded to confirm your purchase.
To avoid delays, please enter the following when placing your order:
- an email address;
- a fixed telephone no. (work or home) where you can be contacted at
any time during the day.
Also, for any order exceeding a ceiling limit fixed by I2m, an identity document and proof of address will have
to be sent by fax, email or post.
We apologise for the inconvenience, but these measures demonstrate our desire to protect our customers
from card fraud.
7. Secure payment
For credit card payments, the sum is debited from the account at the time of the
order provided prior authorisation has been obtained from the appropriate payment centre, otherwise your order cannot be handled.
Online
payment by credit card is via the “PayPal” secure system which encrypts your bank details when they are transmitted on the Web.
For
payment by cheque, simply send your cheque made out to I2m together with a summary of your order to our address at I2m BP200 14011 CAEN
Cedex. We will despatch your order as soon as we have received your cheque. Only bank cheques will be accepted for orders of over €2000.
For cash on delivery, payment should be made by cheque or cash directly to your postman or your post office on receipt of your order. If you
choose cash on delivery, the amount of your order will be increased by 15 euros.
8. Right of withdrawal. Money back guarantee
I2m offers you 15 working days (instead of the seven full days stated in Article L 121-20 of the Consumer Code), to return a product you
are not satisfied with. You can return the product, carriage paid by you, accompanied by your invoice and the return note duly filled in and
signed.
We advise you to return the goods by registered mail or tracked delivery and to arrange insurance with the carrier for the
market value of the products. This is necessary in case the goods are spoiled or lost by the carrier.
In any event, the goods are
returned at the risk and cost of the consumer.
Only products in unused and complete condition (with accessories and instructions),
returned in their original packaging, will be accepted.
The above-mentioned 15-day period starts to run from the date when you receive
your order.
For refunds, the User is reimbursed by bank transfer in the case of a card payment, or by cheque in other cases.
9. Returns
Parcels should be returned by post (or another carrier) to: 16 bis Fossés Saint Julien 14011 Caen Cedex.
Please
note that carriage for returned parcels is payable by the customer (the goods travel at the risk and peril of the customer).
10.
Disputes and liability
This contract is governed by French law and comes under the exclusive jurisdiction of the French courts.
I2m may not be held liable for non-fulfilment of the contract concluded, either in the case of force majeure and especially disruption or
total or partial strike, in particular of the postal services and means of transport or communications, or in the case of fault by the
customer. May we remind you that it is prudent to back-up the data contained in the purchased products. I2m may not be held liable for the
consequences of incorrect use of products sold on the Website. |
